Legal terms explained – Gross negligence and wilful default

Although the application of these terms, especially in relation to carve outs in limitation of liability provisions, is growing, there are no definitive English law meanings attributed to either term. Therefore, unless the terms are specifically defined within the contract, the parties will be left to rely on arguments based on contract interpretation.
