Mediation proving its worth

Approval of the performance of mediators among lawyers is fairly high, with about 80% of them getting a nod of approval in a bi-annual survey – or Mediation Audit – from CEDR (see News). Which means that around one in five of them didn’t perform up to lawyers’ expectations, for which of course there could be many reasons, such as the mediation didn’t go quite the way the lawyer hoped.

Commissioner named to mediate HS2 disputes

Government has appointed Sir Mark Worthington as its Independent High Speed 2 Construction Commissioner. The role will see Sir Mark – a former aide to Baroness Thatcher – investigate unresolved disputes that have not reached a satisfactory conclusion through HS2 Ltd’s complaints process.

Kier faces £600,000 block crush fine

Kier has received its second fine in the space of a week for health and safety offences. The contractor was fined £600,000 on Tuesday following an incident that saw a block of pre-cast concrete fall onto a worker’s leg during a project to build two rail bridges near Cardiff.

Councils in breach of 30 day payment rules

Almost nine in 10 local authorities are failing to monitor whether their suppliers are getting paid within 30 days for construction work, according to data obtained by two industry trade bodies.

Commercial mediations are on the rise with 12,000 having been performed in the UK over the last 12 months, marking an increase of 20% on statistics from 2016.

Kier fined over school roof fall

Kier Facilities Services has been fined £200,000 this week for safety breaches after a subcontractor’s employee fell from the roof of an east London school in December 2014.

Working at height breaches on the rise

Health and safety consultant the Building Safety Group is reporting a 13% rise in the number of ‘working at height’ safety breaches recorded on construction sites in the last few months.
